An 18-wheeler accident can cause serious injuries and long recoveries. The size and weight of commercial trucks often mean more damage than a regular car accident, leading to surgeries, long hospital stays, and ongoing care.

After a truck accident, the legal process for obtaining compensation is more complicated than filing a standard insurance claim. These cases often require investigating liability, gathering evidence, and communicating with trucking companies, commercial insurance carriers, and multiple parties who may be responsible for the crash.

Experience matters when navigating complex truck accident claims. Pierce Skrabanek has recovered more than $500 million in settlements and verdicts, and bring 30+ years of combined legal experience to every case.

Our team offers bilingual representation in English and Spanish so you can talk through your case in the language you are most comfortable with. Call (832) 690-7000 for a free case evaluation today with a Houston truck accident lawyer.

Soyla's Story: A Pierce Skrabanek Client Testimonial

An 18-wheeler crash changed Soyla's life in seconds.

She was on her way to school with friends when a speeding commercial truck slammed into their vehicle. The collision left her with multiple broken bones and severe facial injuries that required 11 surgeries, including reconstructive procedures.

Recovering from a truck accident is long and hard. Victims may need repeated surgeries, rehabilitation, time off work or school, and face mounting medical bills while also coping emotionally.

Soyla's family turned to Pierce Skrabanek for help during that time. While she focused on healing, our team handled the legal and insurance issues connected to the collision.

The aftermath of a truck accident can be overwhelming. Taking early action helps protect your health and your claim.

Steps to Take After a Truck Accident in Houston

  • Get medical care right away, even if you feel okay. Adrenaline can mask serious injuries. Some conditions, like internal bleeding and traumatic brain injuries, do not show symptoms for hours or days. An ER visit also creates the medical record that your case will rely on.
  • If you cannot, have someone gather scene information. Take photos of vehicles, debris, road conditions, and injuries. Collect witness names and phone numbers.
  • Request a copy of the Texas Peace Officer's Crash Report (CR-3), usually available within 10 days of the wreck.
  • Save anything from the crash, such as damaged clothing, eyeglasses, medical bills, receipts, mileage logs, and pay stubs all help later.
  • Do not record a statement for the trucking company's insurer. Adjusters may call quickly. You can decline. Let your attorney handle communication.
  • Stay off social media about the crash. Posts or comments can be used against you later.
  • Follow your treatment plan. Missing appointments or care gaps give insurers reason to downplay your injuries.
  • Call a Houston truck accident attorney quickly. Trucking companies send investigators to the crash scene within hours, and key evidence can be lost without legal help.

After someone is hurt, the liable driver's insurance company usually offers a settlement. This begins the legal claims process, in which the insurer seeks to resolve your claim quickly and for as little money as possible.

You may be entitled to much more compensation than that first offer, especially after a lawyer reviews your case. Accepting an early payout often means signing a release and giving up the right to seek additional compensation later, even if your condition gets worse.

Types of Trucking Accidents We Handle

18-wheelers are far less maneuverable than passenger cars and need more distance to stop. The kinds of crashes we see most often in Houston include:

  • Rear-end collisions. A loaded semi takes much longer to stop than a passenger vehicle. When a trucker fails to watch the road ahead, the truck's mass turns even a low-speed impact into a serious injury crash.
  • Jackknife accidents. A jackknife happens when the trailer swings out and forms a sharp angle with the cab, often after sudden braking. The trailer can sweep across lanes and trap vehicles underneath.
  • Rollovers. Rollovers usually happen when a truck loses traction, takes a curve too fast, or hits severe weather. Beyond the impact itself, rollovers can spill hazardous cargo and cause secondary crashes.
  • Underride accidents. When a passenger car wedges beneath the trailer of a stopped or slowing truck, the results are often fatal. Missing or inadequate underride guards make these wrecks worse.
  • Override accidents. Override crashes happen when a truck's front end rides up onto the vehicle in front of it, frequently crushing the passenger compartment.
  • Wide-turn accidents. Truckers often swing left before turning right. Drivers caught beside the cab can be sideswiped or pinned against a curb.
  • Tire blowouts. Worn or under-inflated tires can blow at highway speeds, sending debris into traffic and causing the trucker to lose control.
  • Lost load accidents. Improperly secured cargo can fall onto the road, hit other vehicles, or force surrounding drivers into evasive maneuvers.
  • T-bone collisions. Intersection crashes involving large trucks often cause life-altering injuries on the impact side of the smaller vehicle.
  • Head-on collisions. Less common, but among the deadliest. A fatigued, impaired, or distracted trucker who crosses the centerline can kill everyone in the oncoming car.
  • Hazmat incidents. Crashes involving fuel tankers or chemical hauls can cause fires, explosions, or toxic exposure on top of the original collision.

Common Causes of Houston Truck Accidents

Truck accidents in Houston usually trace back to a handful of preventable causes:

  • Distracted driving. Truckers get pulled away from the road by cell phones, in-cab technology, GPS units, and food. A few seconds of inattention at highway speed can be catastrophic.
  • Driver fatigue. Federal rules limit how many hours a trucker can drive in a 24-hour period. Drivers who push past those limits, and the carriers who pressure them to do it, can both be held liable.
  • Unsafe cargo. Overloaded, shifting, or improperly secured loads put surrounding drivers at serious risk. Some cargo is more dangerous than the truck itself in a wreck.
  • Alcohol or drug use. Despite mandatory testing, impaired truckers still get behind the wheel. We take an aggressive stance on any commercial driver who operates a rig while impaired.
  • Negligent hiring and supervision. Carriers that skip background checks, ignore prior violations, or fail to train new hires can be held responsible for the harm those drivers cause.
  • Poor maintenance. Carriers must inspect and maintain their equipment. A skipped brake check or a worn tire can turn a routine drive into a fatal crash.

Common Truck Accident Injuries

Injuries we see regularly in Houston truck accident cases:

  • Traumatic brain injuries. A TBI can affect memory, mood, motor function, and your ability to work or live independently. Some symptoms show up right away. Others develop over weeks or months.
  • Spinal cord injuries and paralysis. Damage to the spinal cord can cause partial or complete paralysis, with lifelong medical needs and major accessibility costs.
  • Broken bones and crush injuries. The force of a truck crash often causes multiple fractures, complex breaks requiring surgical hardware, or crush injuries that may lead to amputation.
  • Internal organ damage. Blunt force trauma can rupture organs and cause internal bleeding. Both require emergency surgery and can be fatal if not caught quickly.
  • Burns. Fuel fires and hazardous cargo make burn injuries a real risk. Severe burns require skin grafts, long hospital stays, and ongoing reconstructive care.
  • Whiplash and soft tissue damage. Even at lower speeds, the force of a truck impact can cause neck and back injuries that linger for months or years.
  • Disfigurement and scarring. Reconstructive surgery, like the procedures Soyla went through, can be physically and emotionally taxing. The visible reminders of a crash often last a lifetime.
Recovering from a truck accident is hard enough without having to fight an insurance company at the same time. Texas law gives you the right to seek compensation when another party's negligence caused the crash, and Pierce Skrabanek has recovered more than $500 million for injured clients in Houston and across the region.

Is It Worth Getting a Truck Accident Lawyer?

Yes. Truck accident cases are far more complicated than a regular car wreck claim. Federal trucking regulations come into play, more than one party may be responsible, and the injuries are often serious enough to change the course of someone's life.

According to a Martindale-Nolo study, injury victims who hired an attorney recovered, on average, 3.5 times more compensation than those who tried to handle a claim on their own. Hiring the right lawyer matters, especially in trucking cases where the stakes and the opposition are both larger than usual.

Calculating the True Cost of Your Injuries

Truck accident injuries are often catastrophic. People come out of these crashes with traumatic brain injuries, paralysis, multiple surgeries, and care needs that can last a lifetime. The losses go well beyond the initial hospital bill and reach into your ability to work, your independence, and your daily quality of life.

Trucking companies and their insurers know how serious these cases are, and that is exactly why they push back so hard against paying what an injured person actually needs.

Take a victim left paralyzed from the waist down after a Houston 18-wheeler crash. That person will need lifelong medical care and may face complications like:

  • Pressure sores
  • Chronic depression
  • Circulatory disorders

Limited mobility forces costly home modifications, ongoing equipment needs, and routine replacements. Lifetime living and medical costs can climb into the millions.

A recent study found that 1 in 8 households suffer extended financial hardship after a serious injury. An experienced truck accident lawyer knows how to project long-term costs accurately and fight for the full value of a claim.

Proving Negligence with Federal Trucking Rules

To win a truck accident case, you have to show the driver or trucking company was negligent. In a regular car wreck, that often means proving the other driver acted carelessly under the circumstances, which is sometimes a judgment call.

Trucking is different. Drivers and carriers must follow specific rules issued by the Federal Motor Carrier Safety Administration (FMCSA) covering hours of service, equipment maintenance, drug and alcohol testing, driver qualifications, and cargo loading.

When a trucker or company breaks one of those rules and someone gets hurt as a result, the violation itself can be used as proof of negligence. This legal concept is called negligence per se, and it can make a strong case much easier to establish.

Saving Evidence Before It Disappears

Trucking is a heavily regulated industry, and carriers are required to keep detailed records, including:

  • Maintenance and repair logs
  • Driver logbooks and electronic logging device (ELD) data
  • GPS records
  • Black box and onboard computer data

After a crash, the carrier runs its own investigation. Once that is done, the truck is often repaired and put back on the road, which destroys important evidence along the way. Some data, like ELD logs, can be overwritten in as little as 30 days.

A trucking accident lawyer can send a spoliation letter, sometimes called a preservation demand, requiring the company to keep evidence relevant to your claim. Pierce Skrabanek has the resources and experience to secure this information before it disappears.

Identifying Everyone Who Should Pay

Several different people and companies can share responsibility for a single truck wreck. Identifying every one of them matters because each may carry separate insurance coverage, which can affect what is available to compensate you for your injuries.

Potentially liable parties in a Houston truck accident may include:

  • The truck driver;
  • The trucking company;
  • The truck or component manufacturer;
  • The owner of the truck, if leased to a different driver or company;
  • The shipper or owner of the cargo; or
  • A third-party maintenance provider.

An experienced Houston truck accident lawyer can investigate every potential defendant and pursue compensation from each one that contributed to your injuries.

Standing Up to the Trucking Company

Most commercial trucks are operated by carriers with in-house legal departments and dedicated insurance adjusters whose job is to limit payouts. Victims who try to handle a claim alone are often pressured into quick settlements that fall far short of what they need.

Our team aggressively represents our clients' interests against major corporate defendants and their insurers. At Pierce Skrabanek, we negotiate from a position of preparation and strength, and we are ready to take a case to trial when fair compensation requires it.

The Truck Accident Claims Process

The sooner you have an attorney handling your case, the better positioned you are to preserve evidence, document your injuries fully, and avoid the early mistakes that insurers count on.

Once you have hired counsel, route every conversation about the crash through your legal team. Even an innocent social media post can damage a claim. While you focus on recovery, your attorney will investigate the facts, request and preserve evidence, consult with experts, and document your damages.

After your case is fully investigated, negotiations begin. Most cases settle through direct negotiation with the trucking company's insurer. You always have the right to accept or reject any offer. When the numbers do not reflect what you have actually been through, your attorney can file suit and prepare for trial.

At Pierce Skrabanek, our litigation team is ready to take your case all the way through verdict if that is what it takes to get you full compensation.

"Trucking companies have resources and lawyers on their side. Our job is to be the ones looking out for you. We take that seriously."

Evidence Needed in a Houston Truck Accident Claim

The more evidence preserved early, the harder it is for a carrier to deny responsibility for your injuries. Useful evidence in a Houston truck accident claim includes:

  • The police accident report, which captures the responding officer's initial findings, witness statements, and any citations issued at the scene.
  • Photographs and video of the vehicles, debris field, skid marks, road conditions, traffic signals, and visible injuries.
  • Black box and ELD data, which can show speed, braking, hours of service, and other variables in the moments before impact.
  • Driver qualification files, including the trucker's licensing history, training records, prior violations, and medical certifications.
  • Maintenance and inspection records for the tractor and trailer.
  • Cargo loading records and bills of lading showing what was being hauled and how it was secured.
  • Drug and alcohol test results required after serious crashes under FMCSA rules.
  • Eyewitness statements taken while memories are still fresh.
  • Surveillance and traffic camera footage from nearby intersections, businesses, and weigh stations.
  • Dashcam and in-cab camera footage if the truck was equipped.
  • Medical records and bills documenting your injuries and treatment.
  • Expert analysis from accident reconstructionists, medical specialists, vocational experts, and economists.

Insurance and Defense Tactics in Trucking Cases

Trucking insurers do not approach a serious injury claim the way a typical auto insurer handles a fender bender. Common tactics you should expect:

  • Rapid response teams. Many carriers send investigators, lawyers, and adjusters to the crash scene within hours. Their job is gathering evidence that helps the company, not you.
  • Recorded statements. Adjusters often call victims while they are still in the hospital or on pain medication, hoping to capture statements that can be twisted later.
  • Lowball early offers. A quick check before you understand the full extent of your injuries is a classic move designed to close the file cheaply.
  • Surveillance. Insurers may hire investigators to follow you, photograph daily activities, and monitor your social media for anything that contradicts your reported injuries.
  • Independent medical exams. A so-called independent exam is usually performed by a doctor selected and paid by the defense, with predictable results.
  • Comparative fault arguments. Texas follows a modified comparative fault rule, and defense teams routinely try to assign a percentage of the blame to the injured driver to reduce the carrier's liability.
  • Delay strategies. Dragging out negotiations can pressure injured victims into accepting less, especially when medical bills pile up.

How Trucking Companies Try to Minimize Claims

Trucking companies work to limit their exposure from the moment a crash is reported. Knowing what they do helps explain why early legal representation matters so much.

Carriers often try to minimize claims by:

  • Repairing or scrapping the truck quickly to eliminate physical evidence of mechanical failure or improper maintenance.
  • Disputing employment relationships by classifying drivers as independent contractors to argue that the company itself is not responsible.
  • Pointing fingers at other defendants, like a maintenance provider, parts manufacturer, or shipper, to muddy the liability picture.
  • Challenging the severity of injuries by combing through past medical records for unrelated conditions to attribute current symptoms.
  • Arguing pre-existing conditions caused or worsened the harm rather than the crash.
  • Producing incomplete records in response to evidence requests, hoping you will not push back.
  • Settling quietly with some claimants to keep damaging evidence out of the public record.
  • Filing motions designed to delay the case in hopes that financial pressure forces a discounted settlement.

Our Houston truck accident attorneys have seen each of these moves and know how to counter them.

Types of Compensation Available

You can recover both economic and non-economic damages in a truck accident claim. The total depends on your medical bills, lost income, future care needs, and factors like pain and emotional distress.

Every case is different, but you may be entitled to recover:

  • Medical expenses, present and future;
  • Lost wages while you cannot work;
  • Lost earning capacity if your injuries reduce what you can earn long term;
  • Pain and suffering damages;
  • Loss of consortium for impacts on your relationship with a spouse;
  • Emotional distress and mental anguish;
  • Loss of enjoyment of life; and
  • Punitive damages in cases involving gross negligence.

Our goal is to recover what you need to rebuild your life.

Can I File a Lawsuit If a Family Member Is Killed in a Houston Truck Accident?

Yes. Texas law allows certain surviving family members to file a wrongful death lawsuit when a loved one is killed in a truck accident caused by another party's negligence.

Under the Texas Wrongful Death Act, the following family members may bring a claim:

  • The surviving spouse;
  • The deceased person's children, including legally adopted children; or
  • The deceased person's parents.

These eligible family members can file individually or together. If none of them files within three calendar months of the death, the personal representative of the estate may file on their behalf, unless a family member specifically requests that no claim be filed.

A Texas wrongful death claim can recover damages like:

  • Lost earning capacity that the deceased would have provided to the family;
  • Lost care, maintenance, support, services, advice, and counsel;
  • Lost love, companionship, comfort, and society;
  • Mental and emotional anguish suffered by surviving family members; and
  • Lost inheritance, including what the deceased would likely have saved and left behind.

A separate survival action can also be brought by the estate to recover damages the deceased could have pursued had they survived, including medical bills, funeral expenses, and the conscious pain and suffering experienced before death.

Texas generally imposes a two-year statute of limitations on wrongful death and survival claims, measured from the date of death. Speaking with a Houston 18-wheeler accident lawyer early protects evidence and makes sure your family does not lose the right to seek justice because of a missed deadline.

Choosing the Right Houston Semi-Truck Accident Attorney

Hiring a truck accident lawyer is a personal decision, and trust matters more than almost any other factor. You need to feel comfortable speaking openly about what happened and how it has affected your life.

When choosing the right truck accident lawyer, focus on these three areas:

1. Specialized Trucking Accident Experience

Truck accident cases are not the same as standard car accident claims. Look for an attorney who focuses on commercial vehicle litigation and has a deep understanding of FMCSA regulations, multi-defendant liability, and the specific defense strategies used by trucking companies.

The Pierce Skrabanek team brings 30+ years of combined legal experience to truck accident cases in Houston and throughout the surrounding area.

2. Immediate Investigative Resources

Trucking companies often deploy rapid response teams to crash sites within hours to secure evidence in their favor. Your lawyer needs to move just as quickly. That means:

  • Sending spoliation letters right away to legally require the preservation of data that can otherwise be overwritten in as few as 30 days;
  • Hiring accident reconstructionists and trucking safety experts to analyze the scene before evidence is lost; and
  • Auditing Driver Qualification Files (DQFs) and maintenance logs for safety violations.

Pierce Skrabanek has the resources and the experience to act on day one.

3. Proven Trial Record

A firm willing to take cases to trial is in a stronger negotiating position than one that only settles. Insurers know the difference, and so do trucking companies.

Pierce Skrabanek has secured more than $500 million in verdicts and settlements for injured clients, and our results speak to what we are willing to do when an insurance company refuses to play fair.

A few examples of past results from our team:

  • $2.0 million. Our client, an 18-wheeler driver injured by another trucker, needed two operations and faced ongoing recovery. We held both the other driver and his trucking company accountable.
  • $565,000. After a truck ran a stop sign and struck our client's vehicle in Dallas County, she required surgery for a back injury. The defense blamed an old medical file. We pushed through, and the final settlement exceeded the initial offers that undervalued her claim.

When you hire Pierce Skrabanek, you get a team that has handled these cases before, knows what trucking companies will try, and has the resources to fight back from day one. We also offer fully bilingual representation in English and Spanish, so language is never a barrier between you and the answers you need.

Frequently Asked Questions

Frequently Asked Questions

Why do I need a Houston truck accident lawyer?

Truck accident cases involve federal regulations, multiple defendants, and aggressive insurance teams, making them difficult to handle without legal experience. A lawyer who focuses on these cases knows what evidence to preserve, what tactics to expect from the trucking company, and how to fight for the compensation you actually need to recover.

What awards or recognitions actually matter when comparing truck accident law firms?

Look for designations like Super Lawyers, Best Lawyers, and the Multi-Million Dollar Advocates Forum, which require nomination from other attorneys or proven case results. These honors signal that a firm has earned respect from its peers and a track record of meaningful outcomes for clients. Rankings that firms pay to appear in are far less reliable indicators of actual performance.

What is the filing deadline for a Houston truck accident lawsuit?

The filing deadline for a Houston truck accident lawsuit is generally two years from the date of the crash under Texas law. Some accident victims try to handle the claim through the trucking company's insurance on their own, only to find that insurers stretch out the process until the deadline passes. Once the statute of limitations runs, options narrow drastically. Speaking with a lawyer early protects your rights and your timeline.

How long will a Houston truck accident lawsuit take?

A Houston truck accident lawsuit can take anywhere from a few months to a few years, depending on the facts of your case and how willing the responsible party is to negotiate fairly. When a case must proceed to trial, our Houston truck accident lawyers are prepared to fight for the verdict you deserve in court.

$565,000 Settlement for 18 Wheeler Victim

Summary: Paul obtained a $565,000 settlement on behalf of Mary Berryman who was involved in a collision with an 18-wheeler in December 2010. The case was settled out of court at a second mediation the week before trial. Berryman filed suit against Jose Peralta and Scorpion Transport in Dallas County Court alleging that Peralta ran a stop sign and caused a collision with her truck. Peralta and Scorpion alleged that Berryman was in the best position to avoid the collision simply by going around him. Ultimately, Berryman, now 62, suffered a back injury that required her to undergo surgery. Peralta and Scorpion contended that the 62-year-old’s condition was related to a prior incident in 2007 where doctor reports showed herniations in her low back and neck. After the first mediation in the case, the mediator issued a mediator’s proposal, which was rejected by both parties. However, at a second mediation, the week before trial, the Defendants and their insurance carrier paid in excess of the first mediator’s proposal. Paul was the lead attorney on the case.
